1984 Sikh pogrom

US court orders

hospital staff

to serve summons

to Sonia Gandhi

by V. SUNDARAM I.A.S (retd.)

Days after a US Federal Court in New York had issued Summons to Congress President Sonia Gandhi for “shielding and protecting” the leaders of her Congress Party who were actively involved in the 1984 anti-Sikh pogrom in India, a Federal Judge has ordered for delivery of Summons to Congress President Sonia Gandhi.

A Class Action Suit against Gandhi was filed by Sikhs For Justice (SFJ), a US-based Human Rights Group, along with victims of the November 1984 under Alien Tort Claims Act (ATCA) 1789 and Torture Victim Protection Act (TVPA) 1991.

28 USC § 1350 - Alien’s action for Tort: The District Courts shall have Original Jurisdiction of any Civil Action by an Alien for a Tort, committed in violation of the Law of Nations or a Treaty of the United States.

SFJ legal counsel Gurpatwant S Pannun said Federal Court Judge Brian M Cogan’s Order further directs the hospital and security staff to give Summons and Complaint to Sonia Gandhi personally in the hospital.

Sonia Gandhi is currently in the US for a “regular” medical checkup. 66-year-old Sonia, who had undergone a surgery in the US for an “undisclosed ailment” on August 5, 2011, had flown there for a check-up in February and again on September two last year.

The Human Rights Group 'Sikhs for Justice', which had petitioned against the Congress President Sonia said that they had handed the Summons over to the hospital and security staff. The hospital has refused to comment on the matter concerning this very important customer but it is inconceivable that they would have disobeyed a Federal Judge.

The Congress claimed that Sonia Gandhi has not received any summons personally. This is the same Political Party which claimed Zero Loss in the 2G Spectrum Scam.
